Welcome to PropertyOS. These Terms of Service ("Terms") govern your access to and use of the PropertyOS platform, including our website, API services, data products, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you are using our Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and "you" refers to both you as an individual and that organization.

If you do not agree to these Terms, you may not access or use our Services.

2. Description of Services

PropertyOS provides data infrastructure for European property markets, including:

• API Services: RESTful APIs for property data, pricing predictions, and market intelligence
• FairRent Products: Rental pricing intelligence and scoring services
• Analytics Dashboards: Web-based interfaces for data visualization and analysis
• Data Products: Quality-graded datasets covering 28 European countries
• ML Models: Machine learning models for property valuation and market prediction

We reserve the right to modify, suspend, or discontinue any part of our Services at any time with reasonable notice.

3. Account Registration

To access certain features of our Services, you must create an account:

• You must provide accurate, complete, and current information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 16 years old to create an account (GDPR requirement)
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• One person or legal entity may not maintain multiple accounts

4. API Usage and Restrictions

4.1 API Access

• Use your assigned API keys and keep them confidential
• Comply with rate limits and usage quotas specified in your plan
• Implement appropriate error handling and retry logic
• Cache responses when appropriate to minimize unnecessary requests
• Attribute PropertyOS as the data source when displaying our data

You may not:

• Resell, redistribute, or sublicense our data or Services without permission
• Use our Services to create competing products or services
• Attempt to reverse engineer, decompile, or extract our models or algorithms
• Scrape, crawl, or use automated means to access our website beyond the API
• Circumvent rate limits, authentication, or other technical restrictions
• Use our Services for illegal, fraudulent, or harmful purposes
• Misrepresent your identity or affiliation when using our Services
• Store or cache data beyond the permitted retention period in your plan

4.3 Fair Use

We monitor API usage to ensure fair access for all users. Excessive or abusive use may result in temporary suspension or termination of access. We will provide reasonable notice before taking such action.

5. Billing and Payment

5.1 Pricing

Pricing for our Services is specified on our Pricing page. We reserve the right to change pricing with 30 days' notice for existing customers.

5.2 Payment Terms

• Paid plans are billed monthly or annually in advance, depending on your selection
• All fees are non-refundable except as required by law
• You authorize us to charge your payment method for all fees when they become due
• You are responsible for all applicable taxes (VAT, etc.)
• Failure to pay may result in suspension or termination of your account

5.3 Free Tier

Free tier access is provided at our discretion and may be modified or discontinued at any time. Free tier usage is subject to additional restrictions, including lower rate limits and limited support.

6. Intellectual Property

6.1 Our Rights

PropertyOS and our licensors own all rights, title, and interest in the Services, including all intellectual property rights. This includes:

• Software, code, algorithms, and models
• Data, datasets, and derived insights
• Trademarks, logos, and branding
• Documentation and training materials

These Terms grant you a limited, non-exclusive, non-transferable license to use our Services as permitted. No other rights are granted.

6.2 Your Content

You retain ownership of any content you submit through our Services. By submitting content, you grant us a license to use it to provide and improve our Services.

6.3 Attribution

When displaying data from PropertyOS in public-facing applications, you must include attribution: "Powered by PropertyOS" with a link to our website.

7. Data Accuracy and Warranties

7.1 No Warranty

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.2 Data Accuracy

While we strive for accuracy and publish quality grades for all datasets, we do not guarantee that our data, predictions, or models are error-free, complete, or suitable for any particular purpose. You should independently verify critical information.

7.3 Market Changes

Property markets are dynamic. Our models reflect historical patterns and may not predict future events, especially during periods of rapid market change or economic disruption.

8. Limitation of Liability

To the maximum extent permitted by law:

• PropertyOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for losses resulting from your reliance on our data or predictions
• We are not liable for service interruptions, data loss, or third-party actions

Some jurisdictions do not allow limitation of certain warranties or liabilities, so some limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless PropertyOS and our affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of our Services
• Your violation of these Terms
• Your violation of applicable laws or regulations
• Your infringement of third-party rights

10. Termination

10.1 By You

You may terminate your account at any time by contacting support. Termination does not entitle you to a refund of prepaid fees.

10.2 By Us

We may suspend or terminate your access immediately if you:

• Violate these Terms or our Acceptable Use Policy
• Fail to pay fees when due
• Engage in fraudulent or illegal activity
• Pose a security risk to our Services or other users

We will provide reasonable notice before termination unless immediate action is required for security or legal reasons.

10.3 Effect of Termination

Upon termination, your right to access our Services immediately ceases. We may delete your data in accordance with our Privacy Policy.

11. Governing Law and Jurisdiction
